EC Court of Appeal awards judgment to Charles Hickox in Cap Juluca case

The Eastern Caribbean Court of Appeal has unanimously awarded judgment for Charles Hickox against Leeward Isles Resorts Limited, the owners of the world renowned Cap Juluca resort at Maunday’s Bay on the island’s west coast.

The judgment is said to be the latest development in the 12 year litigation in relation to the financing of the construction phase of the luxury resort about 20 years ago.

The Court of Appeal set aside the judgment of Justice Janice George Creque and ordered Leeward Isles to pay to Mr Hickox the principal sums advanced by him  that were used for the construction of the resort, plus compound interest on the outstanding sums.

In a press release from the local law firm Webster Dyrud Mitchell Charles Hickox was quoted as saying “I am delighted that the Court of Appeal recognised that the arguments raised by Leeward Isles did not make commercial sense, and that I am entitled to the monies that I have been claiming since 1998.  I am very grateful to all those who have supported and assisted my claim.”

Pam Webster, attorney for Hickox said ” this is an important judgment in favour of Mr Hickox, which makes it clear that the defences raised by Leeward Isles were without merit. I hope that Leeward Isles will now make prompt payment to satisfy the judgment so that this matter can finally be concluded.”

Hickox was represented by Ronald Henriques QC, William Rodger of Simmons & Simmons (London) and Pam Webster of Webster Dyrud Mitchell. David Phillips QC, David Fisher and John Benjamin of Caribbean Juris Chambers appeared for Leeward Isles.
